I would remove the banister for the time being.

I would do as others said or get a different gate. This isn’t safe.

We got a gate that could bend so we could angle it around the top of the stairs, since the banister prevented us from doing it straight across the top, and the one we have at the bottom slides before opening to avoid the banister. I'm not sure there's a way you can safely block that gap.

They make banister guards!
