Asking for myself, please no judgments, read everything before commenting... Has anyone ever conceived and had their child and recieced food stamps from the state and never had the bio father on the birth certificate or DNA tested for child support and told dfs that you didn't know who the father was because you truly feared that if their bio father knew about the kid that he would harm you or your child... And then found out that he passed away or committed suicide, and tried to get support afterwards or anything similar? When I first found out I was pregnant I was with my daughters bio father but as soon as I told him he started trying to beat me and cause a miscarriage, my family helped me get out of the relationship and everything. We had just moved from new york (his home state) back to missouri (my home state) I never told him anything about her after that and he went back to NY. Well I've been receiving food stamps for her and myself but when they would ask about her bio father I told them I didn't know who he was or anything.. I found out that he committed suicide on Halloween last week, his funeral was yesterday. And now my family is pushing me to see if she would receive any benefits from the state since he passed away and is no longer a threat.. What is your alls advise?

I don’t think they would help since technically he isn’t on the birth certificate, and you said you didn’t know who the dad was. I’m sure they would think you’re just trying to get money out of his suicide. There would need to be a paternity case established and since he’s passed already I don’t know how they would actually establish paternity.

That's a tough one. You may open yourself to legal trouble if the state finds out that you knew and lied about it, but if there is proof that he was violent they may excuse that. Consulting a lawyer might be your best bet, find out what would be available versus potential trouble.You might be able to claim that seeing his name in the obituary jogged your memory, but I'm not sure if more lies would benefit or harm you.

You need to call social security I'm thinking they will DNA test next to kin to confirm paternity

You would need a DNA test first but then his family might take you for visitation rights. You will need to ask a lawyer

they would do a paternity test from a sibling or one of his parents

Seems tricky. My dad died a month before my brother was born. My step mom had to get blood from my dad while he was in the hospital, and do a DNA test after my brother was born in order to get social security for him. Unless you have connections to his family, 8 don’t think you can do anything.

Do you know his family? What are they like? If you open thus door they could het rights to see her. If it were me I wouldnt do it. You havent had any help from him all this time, why do it now?

Then again her dad is gone forever? Do you want her to know that side of her family?

The one time I met his family was before i got pregnant, and they seemed nice. When I found out he committed suicide I did reach out and tell them about my daughter and everything. They said that they would want a DNA test to be sure that she is his biologically and if she is that they'd want to be in her life and I feel that she should know all her family, but I don't really want any money you know if they offer gifts that's fine if not that's fine too, you know

I understand that. She needs to know them but just make sure you are okay with her staying the weekends on they seek visits

Honestly I wouldn’t go for it. They can be in her life that’s awesome but if you’ve managed without his help all this time why bother.

@1xmom ..I had a friend yrs ago had a baby with a man..He passed away while on a job out of town.He wasn't listed at all on birth certificate..(in FL.the father has to sign his signature to be on the birth certificate doesn't matter if they aren't married only HE can sign his name on it ) When this young man passed away he had a decent job that had great. Benefits..(sadly he tested positive for Marijuana in his system when his company paid for an autopsy..So his only child left behind did not get $125.000 from his jobs benefits.he only then qualified monthly for $300. From his social security of the deceased father..Some families sadly see $$$ money signs..his mother who couldn't stand the girlfriend hired a lawyer and was trying to keep the $125.000 and acted soo nice towards the baby and mom and when they saw they could not get that money they wanted nothing to do with the innocent baby or mother.Soo Please be prepared for what your about to Open... @1xmom. If you can't afford a lawyer please go to a free legal aid office to Know your right s in your state!
