Legal last name but ultimately the babies last name is your choice.. my sons last name is hyphenated because I wasn’t married to his dad

@keeondracarroll01, Your name doesn’t automatically change to your husband’s name when you get married. You have to submit paperwork to the social security administration & get a new ss card with your new name. If you didn’t do that then your legal last name is still your maiden name.

Whatever is on your ssc is your legal name.

Well with my kids, I got to put whatever last name I wanted. I chose my husbands before we married for my youngest and my maiden with my oldest.

I don’t remember ever being asked if I was married, but I also never filled out the birth certificate. My husband always does it 🤷🏻‍♀️

So the baby is someone else’s & not your husband’s? Check in to the laws in your state. In some states if you are still married then he is legally that child’s father even if the biological father is someone else.
