STORY TIME. I had a job as a medical receptionist that I started when I was a few weeks pregnant I let the office manager know up front and I was very transparent about everything. He was cool with and hired me for the job. As my pregnancy progressed I was diagnosed as high risk so I had to go to the doctor more often, again I let him know and he was supportive. So as I take maternity leave at the end of my pregnancy he asked me if I was going to return and told him yes. He only asked that I let him know when. About 3 weeks after my baby was born I contacted him about my return and he told me that he couldn’t allow me to comeback because a coworker had told him that I wasn’t coming back. So I was basically fired while on maternity leave. Now I’m just staying at home with my newborn which is good but I’m still mad about how things happened. What would y’all do?

I think that’s something that would be taken to the Human Resources department. He believed hearsay over your agreement you had made with him. And that’s not right.

@db413, that’s what I thought too. I kinda let it go and just thanked him for the opportunity but it didn’t sit well with me. I know it wasn’t an issue of performance because I received two raises the time I was there.

- I would raise hell.. for one hear say.. for two, it’s illegal to be let go while on medical leave. 😒 I’m a bissh tho. 💁🏻♀️

@beccaaalynnn11, I’ve contacted a lawyer after reading up on at will termination I think I’d have a case.

- You may just call back and be like, so my lawyer told me that I shouldn’t have been let go.. just sort of subtly drop or hint at having a lawyer. Suits coat loads of money and take time. It’s like calling their bluff ?

Does your job have fmla....if they do, you should be covered by that. If they have fmla and they fired you while on maternity leave they can get into huge trouble. If you are covered by fmla it is illegal for them to fire you while on maternity leave. Contact the human resources department to find out.

Your job isn't protected if your not on FMLA. You can be fired while on maternity leave but not because your on maternity leave. It would be your word against theirs unless you have things in writing. It would be tricky case. Did they replace your position with someone else or eliminate it? That would matter.

No FMLA because I was there under a year. Oh well. 😞
