At a loss....

Stepson is 9 and does horribly academically. He is struggling more this year than ever especially in math and reading. I spent an hour and a half doing 3 math problems with him. (Not exaggerating) I refuse to give him the answer, I make him work at it. This morning I brought to DH's attention the struggle last night and we need to get a private tutor or look into a charter school for him because this spending 3 hours a night on one child's homework is getting out of hand. DH's response was that the teacher needs to spend more one on one time with him!!! (He has an iep and already is allotted many advantages over other children). I don't know what to do anymore. I am so frustrated. I work so hard with all the kids and stress the importance of academics and grades but it goes in one ear and out the other. Any helpful suggestion before I wipe my hands clean of it (not of SS, but letting DH do all homework and school related things)? We have him 100% of the time, as his mother is in prison. We have my 3 sons 100% of the time as their father passed. I just don't know what to do I am so overwhelmed!
