Any real estate attorneys?
I need some advice if someone could help.
So we were preapproved for a mortgage and put an offer in on a house with our offer accepted. We got threw the home inspection and were waiting for a commitment letter from the bank when they denied us for a delinquency on my husbands credit from over a year ago. The seller is coming at us for the survey and title on the house that they had done. They waited a month and a half after we cancelled our contract and after they had a new contract pending with new buyers to tell us they want us to pay the $730 dollars. Can they legally ask us for this money? Should they have waited until after we got the commitment letter from the bank to do the title and survey?
I'm not an attorney but have my license, I reside in California.
There will be a time limit of when they can come after you financially for things, and that can vary by state. Also, as the buyer, if these are things you requested them to do but did not write it contingent to your offer, then yes you can be held financially responsible for them.
ETA: I would suggest contacting your buyers agent you used and inform her of what is going on, I know in California you sign an agreement saying you will attend arbitration before going to court to settle things.
