I mean, we are going to have to find a way to take her court... but we can't just not give him back to her. If you have him now, go to the courthouse & file for emergency custody. You can do it by yourself without an attorney. Get affidavits from talks common friends & bring them with you. It can get signed by a judge the same day.

He had to petition for emergency modification to their parenting plan. Is that the same thing?

No it's not. That's a petition for a court date. There's an emergency custody packet you can file. My sister did it years ago bc her children's father wouldn't return them & was planning on leaving the state with them.

Thinking of it, bc they have a court order set he might have to wait for the modification. Can you call a legal advisor & ask? In Florida there's Legal Aide & they give free legal advice.

Ugh that sucks. Maybe next time u know she's driving with him while high u can call the cops and have her stopped. That would be proof

And ss3, we've tried to have her caught with that and other things and she always gets out of it because her dad is the county sheriff. We have tried so much but it's never enough, but we aren't going to stop.

How old is your stepson? Is he old enough that someone from child services could talk to him about what's happening? If he tells them how he's always staying with other people or she's leaving him alone it might help your case

Heather he's 7, and he doesn't talk about it ? He never tells us what's going on over there. He tries to protect her. He loves his mom but he knows something is wrong and she isn't there. He knows he gets attention and love with me and his dad, he doesn't get that over there. We don't pry, we ask him and try to make conversation about it but he doesn't open up.
