Legal rights?
Long story short, my husband has recently brought our house, his parents Owned it but he’s now taken out a mortgage and it’s now officially his. I’m not on the mortgage but I’m down as living there. I just wanna know if anything went wrong (touch wood it doesn’t) do I have any rights to half the house? He keeps on oh we own a house now ect but I’m like no you do I don’t :(

I believe you do if you register with the home registry for matrimonial home rights or something like that, try googling it but I've heard something about it before xx

You're married aren't you, I thought that would seal it being half yours if anything went wrong? x

I'm sure I've read something that you'd need to be able to show that you've contributed to the house i.e bills but that may be for couples who aren't married x

If anything happened you are entitled to half of everything but if your name isn't on the mortgage your not entitled to the house at all. Surly if yous are married you can sit him down and speak to him and see if he would put your name on the mortgages security for you? I wouldn't go sneaking behind his back trying to get security cause that could cause alot off problems between the pair off you xxx

Surely if you have a will and he makes you in there as beneficiary of his estate then you get the house?
Or are you referring to if you split up?
I was under the impression if your not named on the mortgage then it's technically not yours?

Yeh I mean if we split up. Can you add someone’s name to the mortgage at any time?

Yeah but you'd need to go through the same process he did. Credit checks, standard income and there will need to be a solicitor present to add you. Is there a reason he didn't out you on it? I mean did he not even ask you? Xx

Just googled it and saw about doing the whole process again! When I asked him about it in the first place he said it didn’t make a difference If I was on it, it would be mine if anything happened to him but I meant if we split up. I wish I had looked into it sooner and questioned it more! X

Hmm yeah. If you's are married it's weird that you arnt on it. Again all you can do is talk to him. He probably thinks you's won't Ever split up which is sweet but no one knows what is around the corner. Xx

Just thinking about Incase which i know I shouldn’t but it was officially his house as of today. So it’s very fresh and him and his family are all saying congratulations your both home owners he text me today saying we officially homeowners I just replied congratulations babe. Cos I didn’t wanna ruin it for him or cause a row. We are living at his parents as been refurbishing the whole house since the beginning of January. X

Your maybe just being paranoid hun. It seems like he's really happy for you's to finally have a home that's yours on paper. He maybe see's what he has as yours as well. Xxx

When we first moved in together I was in the same position, I completely understand why you would feel unsettled. I had no reason to feel we would break up but I hated my name not being on the house. We spent a lot of money doing it up then instead of selling I insisted we get a joint mortgage on it but solicitor said that was pointless. So we sold under him and his brothers name, they had a joint mortgage but his brother moved out when I moved in we gave him cash but no contract. Solicitor said we would be paying all the fees to add me to a mortgage and applying for another mortgage which was silly. Now we have our house and my reduced hours there is no way I could afford a house without my husband my part time hours cover all my bills but nothing else so if we split up I couldn’t buy him out, he reassured me that will never happen and he wouldn’t expect me and baby to move out he would build an annex for himself ? I think give it some time maybe six months and tell him it’s unsettling you

So your not on the mortgage either? I couldn’t afford to buy him out either I’m on a low wage and tbh his family wouldn’t see me out on the street with his child so if worse came to it hopefully they would help me somehow. And tbh I’m gonna have to move on from this as it’s not gonna change anything.

I wasn’t for three years before we bought another house together and it never sat well with me. I know because we are married we would both get 1/2 of everything. Your husband sounds similar to mine he always said it was our house. If you know you have people who wouldn’t see you without that should hopefully be reassuring

I think if he bought it before you were married he could take all. After marriage is different. You need to read up on it x

He brought it after we got married. Just gotta hope it all works out. If not we will be selling up in the future and buying together!! Il make sure! X

Legally it doesn’t matter if your name isn’t on the Mortgage...when you divorce (I’m going through this now) anything bought during your marriage belongs to both of you unless it is a gift from someone else....
