No, a judge won't give him an order to where he can claim your child every other year. If you are the custodial parent, and have all school documents, medical records, pretty much anything stating that you are the primary caregiver for your child then he wouldn't be able to claim anyways. My dh has an order like that set up with his son, but only bc he has a shared parenting plan with his sons mom and split time completely. In his parenting plan it is stated that he is to be equally involved with school documents and medical records and stuff like that for that purpose.

Yeah he's not even around enough to do these things. When he texted me about taking me to court, he wanted to put her on his "insurance" and wanted me to drop child support all together.. lol I called they don't cover $hit it would cost me an arm and a leg, he wouldn't pay the bill I'd be stuck with it since I have full custody , just to take her to the damn doctor. So I said no she's staying on mine. I'm just scared they will grant him that, he doesn't do anything for my daughter, he's bought her a pair of diapers and a 40 dollar carseat her whole life. He's crazy.

Even if he does claim her you could mail your return in to the IRS, they will send a packet to each of you and whoever proves they provided for the child gets to claim him/her.

I'm fairly certain a judge wouldn't allow him to claim her on his taxes as you have full custody and he's well behind in his child support. If anything if he gets anything back the owed child support could be taken out of that.

Well here he can't claim without that stuff anyways its the way the irs changed it this year , they asked for a doctors note and a child care providers note stating that you are custodial parent I basically had to prove she was my child and I provided threw the year for her. I just wish this a hole would leave me and my child alone it's so annoying he's not even in her life and he is constantly bothering me about what he did to himself.

Yeah , I didn't think so, I just don't think , he should get a break and "catch up on child support" with the tax money he would receive for her. You know I didn't get him behind he did, by not paying, why should the tax I pay out yearly for her help him at all. It's all about money with him is disgusting to me.

In 2009 he demanded i give him half of my tax return. He saw her maybe once a week for a couple hrs if tht. Never bought or paid for anything- i told him to f*** off. Irs laws are you can only claim a child on taxes if you can prove you provide for more than 6 months of that childs care. The only time judges give the opportunity to parents to claim taxes every other year is when both parents share custody equally, then both parents end up having the child each 6 months. If he tries to file call and have him red flagged by the irs. The only proof youll need is that you care for your child 6 months or more out of the year, being that you have full custody that shouldnt be an issue. Men like him are stupid, sorry but hes just a deadbeat trying to figure out a way to screw the system and get out of his responsibility. I agree, he shouldnt be able to get money from your child who hr doesnt support only to hand you the money back trying to get himself out of a mess. What a d***. Also try and file your taxes asap. Oh iv already filed lol but I still can't believe he's dumb enough to walk back into the court house 4 grand behind on payments......I hope they make him look absolutely stupid in front of everyone like last time.

My ex tried to get me to let him claim our son last year. He wasn't going to give me very much of what we got so I said no since he wasn't even living in the house with us.
