I have a serious question pertaining my situation... On my daughter's birth certificate, her bio donor is not listed but he is paying child support and had never been there for her since she's been born and want no responsibilities while my fiance has been there for as her Papa. He loves and treats her as his very own and nothing different than our other two daughters. How will and what's the process did you go through to have the stepparent/domestic partner on the birth certificate and name change in California? I need options/advices... Thank you.

You have to get her bio dad to sign his rights and okay the change

If it’s like in Texas, they have to adopt them. No other way on the birth certificate unless that’s done.

Not easier if married, in California the bio must sign his rights away and if he doesn't they require 2 years of no contact or any child support in order for it to be abandonment. Once the rights are signed away then and only then can the stepparent be added on the birth certificate. Going through this now. Or trying to get it started but since his child support is a garnishment I'm screwed bcuz it's automatically being taken out. If it was Bios choice it wouldn't get paid

It's called Stepparent Adoption. Also, the stepparent will have to get fingerprinted and will be investigated to show that he is better off being the child's father than the biological father. It is a process. With name changes you just go to courts so I thought this would be the same. Nope, because it's a stepparent it's more complicated

@reddroses14 thank you for the information. Well the bio has never been there and only paying child support because child support services requested I didn't. But yeah he's never seen or been there for her my fiance has been there for her since she was born.
