Looks like they do have rights, but the court has to determine that it would be in the child's best interests.

Honestly, sounds like she def would not win in court. Just make sure you don't react to anything she says on Facebook (no visual record) but keep records of everything she has done or said that you have proof. So screenshot that fb status and prepare a defense for yourself in case she backs her threat.

Yes they have rights but it would be no more than standard visitation, once a week and every other weekend I believe. If a relationship has been established then she has rights, if one hasn't been established then she has no rights. But like you just posted, with that record, she wouldn't get more than supervised visitation, and that could be slim to none if her record has aggressive felonies or anything like that. You can put in the order that you don't feel safe with your daughter being alone or going anywhere with her because of her dui so that could set you up for supervised visitation. It's almost impossible for her to get an ample amount of time. I seriously wouldn't stress on it. KEEP EVERYTHING! Texts and voicemails and screenshot all shit talking posts she posts about you. If she's going to disrespect you she's disrespecting your daughter which is not ok. And if she talks like that around your daughter, and talks poorly of others In front of her it can be considered a form of child abuse. You have nothing to worry about 💜
