Are you flying? According to some websites you need a letter from the other parent if you're not flying together. I was worried about that because I took my son to Minnesota when he was 4 months and didn't get the letter, but we had no problem getting through the airport even though I have a different last name. Driving I don't think you'd have to worry about that.

It'll depend on what the custody agreement stipulates though.

I would wait and see what agreement is my parents had it stated they needed permission to leave with children out of state for vacation but my mom never got his permission and no one ever asked for it but if he finds out you took them without talking to him and it's stated you have to he can get you for custodial interference

If you wind up needing one, this is what lawyers.com recommends. Unless there's something in your custody agreement, though, domestically you shouldn't need one. I always prefer to be prepared just in case, though. I did bring his birth certificate when we flew alone though!

The US department of state recommends that you get one, though.
