Well I think if you did not claim him, and your step dad did not claim him as a dependent since you don't work... then as his father I think he can claim him legally. My ex husband would claim his daughter even though she lived with her mother, because he would get more back than she would... and then he'd split that part of the return with her... but he was a very good dad... and really took care of his kids!

@missjess, yeah I can see where that's frustrating! But if no one else claimed your son, I don't think legally he did anything wrong... so just be prepared if you do bring it up in court, that it might not go the way you would like.

Whoever the child lives with for the majority of the year has the right to claim them on their taxes. Both cannot claim them and the IRS will send a notification if that does occur. The easiest way to correct is if the father did not take care of the child for more than 182 days of the year, he can file a correction and pay the difference. Even if he makes 95k he will still get a deduction which long story short is money. @missjess
