Unfortunately I can't get sole custody in NY state unless his father was like a sex offender. Fathers here have more rights these days I guess no matter how crappy a dad he may be to my son. So my lawyer is putting joint custody on the table with me having physical custody and the baby isn't to go overnights with him till he's over 2 years old. So we'll see what happens @ashcos,

Yah PA is the same way! My daughter didn't see her father for 5 yrs and he ended up with joint custody. It sucks but hopefully it works out for you.
