So my baby had a fractured clavicle from when he was born. Thankfully he is healing very well and moves his arm fine. I was told that I can sue the Dr. that delivered him for medical malpractice?? Anyone know if this is true??
The Dr didn't know because he never even came back to check on me and baby. His pediatrician checked him twice and never found it either. I didn't know either because he would only cry when I would hold him too close. My baby also ripped me open so bad because he was too big and that's why he suffered the fracture @beebaby My Dr did know the baby was big that's why he decided to enduce me before my due date. he weighed 8lbs 15oz. But like you said @heyycodyyy my baby is doing great and was just discharged today so we are blessed that he is healed.
It would be different if your dr knew baby was too big and didn't stop the labor to help ease him out. Odds are, the dr didn't know anything was even wrong. Plus, most hospitals make you sign paperwork that includes the risks of labor and pp and anything that can and or will happen during those times. With my csection I had to sign forms saying it wasn't my drs fault if I died in surgery (hemorrhaging that wasn't able to be controlled or if I had a bad reaction to something), or if I got a reaction or if there were any complications pp that I didn't report immediately. You just have to take it at face value, your baby is going to be okay and you go it checked out a week later, stuff happens in labor that sometimes can't be controlled
I do think most lawcases don't amount to much. Hospitals have a lot of money and will just delay everything until you have no money. I didn't sue over my son's dystocia. But if he would've had palsy, I would pursue it. It is wrong for the doctors to not say anything
When I was pushing him out the Dr never coached me through it. Normally they tell you to stop pushing or to push harder! but he just stood there and let me push!!! So I think he came out too fast and he didn't have time to position him correctly. He was out with 2 big pushes.
The thing is that the hospital never told me that it was fractured. He was diagnosed at his pediatricians office almost a week later. I wasn't even able to breast feed him because he would just cry when I would put him close to me and I didn't even know why!!! @bonniesue @beebaby
Well if it wasn't broken from the baby getting their shoulder stuck, you'd probably need the medical term and reason why it happened but it could likely be a lawsuit if you wanted
No it wasn't dystorcia it was a fractured clavicle it was completely broken in two. I cried so bad when I saw the xray!!! It just broke my heart. @bonniesue
