my midwife agreed to take me out of work, no bedrest though. she also said because I'm going out 2 weeks before my induction, I have to sacrifice 2 weeks with my son... I lose 2 weeks of disability which makes no sense because I need that 6 weeks for healing my body and my son needs me home with him. can they legally take 2 weeks of my maternity leave away from me?

If you're only allowed 6 weeks of leave due to pregnancy/childbirth....absolutely they can do that.

What exactly does your disability leave statement say? 9 times out of 10, once you leave work during pregnancy it takes away from your time after birth. I have 26 weeks total. I left work 10 weeks before my due date, that leaves me with 16 weeks with my baby.

I have a 26 week maximum only if there are complications. 6 weeks is all I will get as well. I can't get FMLA bc I am not there a year. 😩

@dabcw3814, I have fmla and can use my own time after disability is done if I want to. i know people in training that have fmla though.

My company requires 1 year of employment to be entitled to FMLA. I can use 6 weeks if I have vaginal and 8 of it's a c-section. I have about 1 week of sick, personal and vacation. I only get $170 a week of STD and apparently it's paid in a lump sum.
