It's very legal, but unfortunate.

well you can still apply for disability not maternity.... they can term used while u are out bc you will not have fmla for job protection however I would apply for disability so u can get that money for 12 weeks and if u get term used can go on unemployment

That's too bad. It does have to be a year. Maternity leave is horrible in the United States!

You qualify for maternity leave if you been with a job for 6 months or more not a year.
