well my stress level is through the roof!!! My husband and his friend got pulled over right by our driveway tonight and they searched the vehicle for smelling like marijuana and didn't find anything. So they came to my house and searched my husband's shed. we'll they found 3 pipes and maybe like 3 grams of marijuana if that. well where we live is zero tolerance and this would be my husband's second offense in the last 4 years. he was sentenced to 2 years probation last time which got revoked after 1.5 years due to him dropping dirty and going to jail a lot for it. Well now he doesn't know what the hell they're gonna do or charge him with. I'm stressed because if he ended up going to serve time for a marijuana charge 2nd offense he'll probably have to sit in jail and he may end up missing our sons birth. I'm freaking out because I would NEVER forgive him if that happens. I'm gonna be highly stressed for the next few weeks until we know what the hell is going on... I'm about to have a meltdown 😢😢😢😢

well a lot has changed in the past 4 years about marijuana legalization and the laws and what they do to people who break those laws. I hope since it was only 3g they just give him a slap on the wrist.
@ninanicole2, I told him to go get his med card because then they couldn't have done anything to him. and I just found out that not the smell of marijuana isn't probable cause to search a vehicle or home anymore. he had it in a bottle from the dispensery (his buddy flips the extra growth for more profit after selling to the dispensery)
@mc.squared I'm going to have my husband talk to a lawyer about it because he had not right to come on the property without a warrant in the first place but my husband was cooperative. I'm hoping they just kind of push it under the rug at this point but I highly doubt they will

I dont know where you live at in Michigan but their actually trying to pass recreational use and where i live at here its pretty much a slap on the wrist as long as you have no intent to sell (have baggies or a scale on you) so you most definitely could get a lawyer. I would suggest him trying to get his med card, because where you live at in michigan may be zero tolerance its still legal if medically necessary. v
I personally don't care if it's legal or not cuz I don't smoke although my husband does but I really think it should be either or everywhere and not different laws from state to state.
I really hope he doesn't get charged with anything too serious! 3 grams?? ugh I can't believe they even waste their time!! I think it is rediculous that in one state it's completely legal to smoke recreational marijuana but in the next state it's treated like a hard core drug!!! smfh. it makes no damn sense at all!

@ktwins188, they cannot take the children since they're in my care and not their fathers. I was here with them when my husband got pulled over. if they would have found something other than marijuana it would have been a different situation until I could prove I am clean and drug free. Which is easy for me. I talked to my mom's lawyer about that last time this happened and he assured me that if they were only in his care it'd be a different situation unless something else like meth or cocaine were found
@themommaoffour, well that's a good thing they didn't arrest him right? maybe they won't put any charges on him hopefully I live in New Mexico if someone was caught with weed they be arrested they wouldn't just let them go home
They had probable cause to search the shed then if his friend admitted he had a pipe on the property. But again none of us are attorneys nor do we know your state laws. Sorry you are going through that.
@kayloniandkirksmommy, I'm hoping that they throw it out. @preciouslove they didn't arrest my husband but took everything they found. his buddy would have got to the next town over for a blood test to see if he'd test positive for it (which he would) but there is a huge fight and shooting and the hospital is very busy and full because of the shooting and they are impounded his vehicle
you should also be greatful they didn't take your kids away for having drugs there....
I find it illegal also but you wouldn't be able to understand if you don't know all your laws properly and unfortunately many people don't there blinded which is unfortunate it's exactly what the government wants
That's still illegal even if it's a zero tolerance place they searched illegally
@shylaremmelts, thank you. @babyrossmommy yeah its his 2nd offense and the officer that pulled him over and did the search got shitty with me last time saying that he'd charge me with it and I was pregnant with my third and I told him go ahead they'll make me drop and do a blood test and I'll pass. (he wasn't charged because they had no proof that time but they found 2 pipes on the porch between apartments and they were on a table) @countrymama2015 I don't think a lawyer will be much help with it being zero tolerance and his friend admitted that he had a pipe but not on him and they're staying with us this weekend and they came and searched

the search of the house seems illegal. the search of the car was legal for probable cause, the scent of weed. talk to a lawyer. My husband is in jail and missed the birth of our son :( do whatever it takes to figure this out.
Honestly I would call a lawyer. If they didn't have warrant that don't have probable cause to search your house. They got pulled over in the car on the street. I would get if they got called to your place and found but they didn't. So they might have found illegally and the case could get thrown out of court.
