you can call the irs and let them know to put an alert but your tax preparer will be able to tell you exactly what to do if some one claims them unauthorized and that person will be audited and have to pay it back it will probably hold up your refund tho

if he's already done it once and it's court ordered that you switch years, you should be able to take him back to court. he might have to pay the money back that he got from claiming them

just send proof of court papers. you will just have to prove he claimed them last year and you didn't and he will have to do the same.

@mrsmoore, sorry. what I was trying to say was if you both claim the kids. the irs will want copies of your court papers stating that you trade years and that they may want a copy of your last year's return to prove that you did not claim them. they will ask the same paperwork of him.
