so 3 cops just came and took my boyfriends dads roommate to jail and his dad had gotten home and said when he walked in the house the whole house smelt like weed and me and my boyfriend have been in the bed since 9 and he smoked outside so were thinking the roommate was smoking in the house not thinking they were coming to get him tonight so now I'm really nervous if they come back and try to take us to jail too 😭😭😭

na girl legally you can stand right in front of them high as hell and the only thing they could get you for is public intoxication. they have to catch you in order for it to be a drug charge or a charge at all i your own home, your fine:)@amberr_0302

unless they have a warrent to search which those are hard to get sometimes you can smoke right in front of them as long as you're on your property.

@justinjrsmommy they had a warrant to come and get him which went active today , but idk if they would have to get another to search the house or if they could use that one

if the warrant was to come and get him than once the warrant is satisfied, the warrant is no longer even justifiable. in fact once they have him, the only thing they ca. justifiably do is leave. now the plain view doctrine would apply and that is it. (simply means if they saw something in plain sight, not issued to search in the warrant, they could seize and charge for such item). if they are gone. they have concluded their search warrant. can not come in without a new warrant with specification to what it is for or unless invited in. rest easy. but hopefully you are not submitted to future issues of people being so irresponsible where you and your child could be

I don't even see why they would honestly. nowadays more cops smoke than normal people. but if the warrent was just for the dude and not to search the house you might be okay.
