I would gave the baby the fathers last name because just because things aren't going great with you guys doesnt mean he wont be a good father now or in the future and it still is his child . But if he wants nothing to do with the baby than the last name you plan on using

This child isn't apart of your husband, so definitely don't give it his last name, I would give it yours since you want nothing to do with the babydaddy. && if you and the husband work it out, maybe he'll want to adopt and change the babies last name to his.

Depending on your state law. A child that is born while you are married is legally your husband's in the eyes of the court. The only way that is revised is if the sperm donor fights for rights. But I would go with your maiden name
