Just curious..I have a 5 year old son by my ex & a 4 month old with my current boyfriend. My ex is NOT on my son's birth certificate & has nothing to do with him (which I'm okay with!) however we do have a pending case for domestic battery, next court being in April. I'm curious as to if I'm legally allowed to move out of state. Technically he has no rights, correct??? I'm in Indiana and we are currently looking at possibly moving to Florida.

if you have no child support/visitation set up, I don't see why you couldn't move out of state, but if he does all of a sudden wasn't custody/visitation that may change, kinda depends I guess.

you wouldn't have to stay, but there would have to be some sort of visitations set up.

@lovemyson_610, but if he were to have like visitations or anything saying he's the dad or if he was to all of a sudden fight for some type of custody it could cause me to have to stay?

as long as he has nothing proving he's the father, you're allowed to go anywhere you want!
