If I am renting a bedroom out of a 3bedroom apartment, and give money to the person on the lease for rent, is it legal for her to not spend money on the actual rent???? I just saw a note on the door yesterday that was a 3 day notice and it clearly said rent had not been paid (even partially) for Dec or Jan. I know I gave her half the rent both times (she in fact gets a little rude about it). Now...I am already frustrated I have to move right when the twins are due, but I am curious where the hell the money is going, her daughter didn't get any Xmas presents, no rent was paid, and she supposedly went to work several days of the week a bunch of times. Can she take rent money from me and not spend any money at all on rent???

the problem is, legally you're not allowed to be in that apartment unless you're on the lease. so yes you have legal standing since you have a written agreement with your "landlord" but ultimately you have no legal standing with the apartment complex, but that's her problem not yours. SHE'S violating her lease by renting a room to you under the table without putting you on the lease.

I had a 3 bedroom apartment and I rented out 1 bedroom and my dinning room (desperate people needed a place to sleep pretty much) I had 8 people and 3 dogs in my house and I was well aware of the fact that I was violating my lease, but rent was always paid on time in full. I told all my roommates I wanted them to get on the lease and they never did, so when they moved out and didn't pay me money they owed me I kept their stuff and sold it. every single one got mad and said I had "no right" to "steal" from them, BUT if they had been on my lease like I told them to be then we wouldn't have the problem. but they weren't so legally they were never there and all that stuff was mime. so if you moved out like, tomorrow, make sure you take EVERYTHING with you.

if you pay her for rent, and she uses that money for bills or whatever but rent is still paid every month, it's not really a problem. but you're paying her rent and rent has not been paid. she's about to lose her apartment and in turn you'll lose your place to live and it'll be because she screwed you over.

I would start looking for somewhere else to live ASAP and take it up with her before you both get a 30 day notice to move out and you're caught off guard.

Oh well in that caser, no she can't just take the money from you. you gave it to her to pay your share of the rent and she abused that and didn't pay rent. next time, write a check out to the apartment complex, that way she can't cash it for herself and if the office asks why it's not her name on the check she can just say that you're helping her out for the time being

look under single lodger in a private residence. i would assume that it would apply to you although it's an apt. and this link is helpful too - ссылка

yep, that's how it is here in MD. you're considered legally a resident if you've been at a place for 30+ days. regardless of any legal agreements between the home owner/renter and the landlord/apartment people. so definitely look it up for your state. she definitely stole for you and has inconvenienced you in a major way so yeah, get your money back & then some for pain and suffering 😒 lmao

Hell yes you can sue her! You have a written agreement and it's stealing REGARDLESS if you give someone money for something and they use it for something other than what was agreed! Not only that but now this has effected you last minute . You can definitely sue.

OH! now that i think about it.. i'm not sure if the law is different there buttt you may be good in court bc legally after staying at a place for more than 30 days the state considers you a resident at that address. meaning had she tried to kick u out for any reason she would have to go through a process of getting u an eviction notice notarized and by law you's have 30 days to move. so, that may work in your favor. i'd say find a piece of mail that you have coming there with a date on it from as far back as u can find. get a few pieces as proof if u take her to court just to prove you have been living there for quite some time.

Awe thank you, I am focusing on having faith my husband will find us a new place ASAP, because he already has some prospects ever since I told him after I saw the note, so I am hopeful. thanks for talking to me 💜 @mango44

Is it stealing if I have been living here though? I am concerned i will have to sue her for the deposit and also the money she borrowed for cable these last 2 months (almost $500) @muva.mermaid

SUE HER ASS! You have babies on the way and you did your part so you do not deserve that! Take that up with the legal system bc now last minute you have to find somewhere to stay and she been stealing your money

well just be glad that it's gonna hit her credit & not yours. if u have a written agreement and some proof of payment u may be able to sue her even though you weren't listed on the lease agreement.

There is no "now on"....she owes like 5k, there is no way she will catch up, I believe she plans on skipping out. She in fact blames part of the reason she is leaving on us giving her checks instead of cash (???) @junebug2016

We have a written agreement and some receipts...I am just super appalled she wouldn't tell me at all, not the first month she didn't pay so I could live my life like I was going to move, not like I was going to stay. I wouldn't have gotten pizza all those times 😒 It is me living here illegally ...everyone in this complex does it, so I doubt she cares about the eviction... @mango44 @arijane316 @muva.mermaid

if your name isn't on the lease and you don't have a written agreement with some type of proof of payment each month, then u were just giving her money basically :(

also what @muva.mermaid said. she technically stole from you. you gave her the money for a specific reason and she didn't do what it was intended for. also, I wouldn't let your office know she's living there if she's not on the lease because that will get you into trouble with the complex. when I rented an apartment, I was told that if I had someone living with me that wasn't on the lease, I could be evicted.

You definitely need to take that up with authority and see about getting a lawyer but the only thing is if there was no written agreement it may be hard to take the case to court but you can definitely sue her

if their name isn't on the lease, no they dont have to because they aren't technically supposed to be living there anyway. but the fact that you gave her your money for rent to be paid with and she didn't pay rent is bull shit and she shouldn't be living with you.
