I swear 😭 🤦♀️ my husband and I separated a long time ago and never legally got divorced because he was refusing and now that my baby is born I had no choice but to list him on my sons birth certificate and he still will not help me to fix it he is refusing to go to the vital statistics office with me to sort it out!! Ass hole ugh

Yep. Paternity test will allow him to be removed from the birth certificate.
And a divorce can be done. But your lawyer will help you with that. You can file without him. Depending on were you live will depend on the resources for you. But again your lawyer will be able to help with that.
