Hey momma’s I need some help. I am wanting to divorce my husband because he cheated on me and is still with her. How do I go about leaving him? I live in NC

You could also talk to a divorce lawyer. They usually give you the first hour free while they decide if they can take on your case or not.

@kelseychapman13 I don't believe so... Again, every state is different, but I'm certain you won't have to... Now here in Ohio- there is a $25 fee to sign paperwork to get an attorney appointed to you... When you go to the courts- mention to them about your financial situation and the kids... You can possibly file for some sort of assistance, or they can start up an emergency child support order for your situation...

@danielzamor2007, and would I have to pay for that? The reason I am asking is because when he kicked me out I have no job (no high school diploma) no License or anything I depended fully on him so I have no money

@kelseychapman13 Then- when going to"actual" court for the divorce... You can ask for an attorney to be appointed to you for the actual divorce court date...

@kelseychapman13 You can ask the court to waive the filing fee- based on your financial situation... If you meet financial requirements, they court can waive the filing fee. To apply for the fee waiver, you must complete a Petition to Sue as an Indigent, have it notarized, and present it to the court clerk when filing your divorce complaint. The form will ask you to provide information about your income to help the court clerk determine if you are eligible for a fee waiver. If your petition is approved, you can file for divorce without paying the filing fee.

@danielzamor2007, ok because as of today he won’t have a place to live and I don’t want her around my kids and I can’t trust him to not have her around them because he has broken that several times.

@kelseychapman13 Best thing for you to do (ESPECIALLY BC KIDS ARE INVOLVED) go down to the courts and explain your situation... In most states when kids are involved- they will speed up the process- and even have emergency court orders too...

@kelseychapman13 There is a divorce filing fee- it's usually around $200 or so... And if you want to file to have your last name changed back to your maiden name- that's usually a few bucks more...

@danielzamor2007, I have my mom as a witness and it has really only been a month but I am so fed up with his shit I want to be divorced like tomorrow. Because it is so bad and my kids are suffering because he is picking the whore of his kids

@kelseychapman13 Every state is different (keep in mind)... But, you should be able to go to your local court house and they can help you start the filing process for a divorce... Remember- proof and documentation is very important!

@kelseychapman13 How long ago did he kick you and the kids out? Do you have proof to show that he kicked you and the kids out?? You can write a paper stating - He kicked you and the children out and you are residing with your parents... At that point your parents can sign and date it too...
